1. Agreement
These Terms of Use ("Terms") govern your access to and use of the DrillShot mobile application, related services, and associated websites (collectively, the "Services") provided by Cirsium Labs LLC ("Cirsium Labs," "we," "our," or "us").
By downloading, accessing, or using DrillShot, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use DrillShot independently. By using the Services, you represent that you have the legal capacity to enter into these Terms.
3. Service Description
DrillShot is a firearms dry-fire and training utility application designed to assist users with training drill management, shot tracking, target analysis, AI-assisted target scan features, practice session history, reporting, and performance insights.
DrillShot is intended solely as a supplemental training utility. The Services do not provide firearms certification, professional instruction, legal advice, tactical guidance, emergency response guidance, or safety guarantees.
4. Firearm Safety Disclaimer
Your responsibilities include:
- Following all local, state, federal, and range safety rules.
- Ensuring firearms are unloaded before dry-fire practice.
- Maintaining safe training environments.
- Supervising minors appropriately.
- Verifying the safety and legality of your activities.
DrillShot does not replace professional firearms instruction or range safety procedures. Cirsium Labs is not responsible for injuries, death, property damage, legal violations, negligent handling, or misuse associated with firearms, ammunition, targets, training equipment, or training activities.
5. AI-Assisted Features Disclaimer
Certain features may use artificial intelligence or machine-learning systems, including target analysis and shot interpretation. AI-generated results may contain inaccuracies, omissions, or incorrect classifications.
You acknowledge that:
- AI-assisted analysis is provided for informational and training purposes only.
- Results should not be relied upon for safety-critical, legal, competitive, or professional decisions.
- Users remain responsible for independently verifying all analysis and training outcomes.
Cirsium Labs makes no guarantees regarding the accuracy, reliability, or completeness of AI-generated outputs.
6. Subscriptions and Billing
Certain premium features are available through optional auto-renewable subscriptions, including DrillShot Pro.
Subscription Terms
Subscription pricing and available plans are displayed within the application and App Store product pages. Current offerings may include monthly and annual subscription plans.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
- Payment is charged to your Apple ID account upon confirmation of purchase.
- Your account will be charged for renewal within 24 hours before the end of the current period.
- You may manage or cancel subscriptions through your Apple ID account settings.
- No refunds are provided except as required by applicable law or Apple policies.
Restore Purchases functionality is available within the application.
7. Free Features
DrillShot includes free functionality that may be used without a paid subscription. Free features and premium features may change over time.
Cirsium Labs reserves the right to modify, add, remove, or limit features at any time.
8. User Content
You may upload or create content within the Services, including target photos, drill configurations, reports, training data, notes, and performance history.
You retain ownership of your content. By uploading content, you grant Cirsium Labs a limited, non-exclusive license to process, store, transmit, and display the content solely for the purpose of operating and improving the Services.
You agree not to upload content that:
- Violates laws or regulations.
- Infringes intellectual property rights.
- Contains unlawful, threatening, abusive, or harmful material.
- Promotes violence or illegal activity.
- Contains malware or malicious code.
We reserve the right to remove content that violates these Terms.
9. Intellectual Property
The Services, including software, graphics, branding, logos, interfaces, designs, and related materials, are owned by Cirsium Labs LLC and protected by intellectual property laws.
You may not:
- Reverse engineer the Services.
- Copy or redistribute the Services.
- Modify or create derivative works.
- Use the Services for unlawful purposes.
- Remove copyright or proprietary notices.
10. Acceptable Use
You agree not to:
- Use the Services unlawfully.
- Interfere with application functionality or infrastructure.
- Attempt unauthorized access to systems or accounts.
- Abuse subscription systems or purchases.
- Use automation or scraping against the Services.
- Circumvent feature limitations or security protections.
11. Service Availability
The Services are provided on an "AS IS" and "AS AVAILABLE" basis.
We do not guarantee continuous availability, error-free operation, data retention, compatibility with all devices, or the accuracy of analytics or AI outputs.
We may modify, suspend, or discontinue parts of the Services at any time.
12. Limitation of Liability
To the maximum extent permitted by law, Cirsium Labs LLC and its owners, affiliates, employees, contractors, and partners shall not be liable for injuries or death, firearm accidents, property damage, lost profits or revenue, data loss, competition or scoring errors, interrupted training sessions, subscription disputes, AI analysis inaccuracies, or indirect, incidental, special, punitive, or consequential damages.
Your use of the Services is at your own risk.
13. Indemnification
You agree to indemnify and hold harmless Cirsium Labs LLC from claims, liabilities, damages, losses, and expenses arising from your use of the Services, your violation of these Terms, your violation of laws or regulations, or your misuse of firearms or training equipment.
14. Privacy
Your use of the Services is also governed by our Privacy Policy. Please review the Privacy Policy at https://www.cirsiumlabs.io/privacy.
15. Termination
We may suspend or terminate access to the Services at any time if you violate these Terms, we suspect fraudulent or abusive activity, termination is required by law, or suspension is necessary to protect the Services or other users.
16. Governing Law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law principles.
17. Changes to These Terms
We may update these Terms periodically. Updated versions will be posted within the Services or on our website. Continued use of the Services after updates constitutes acceptance of the revised Terms.
